Patient Bill of Rights
We at SWIBH view behavioral health care as a partnership between patients and providers. We respect your rights, values and dignity. We also ask that you recognize the responsibilities that come with being a patient, both for your own well-being and for your fellow patients and providers.
Please read and exercise these rights and responsibilities as outlined below. Should you or your designated guardian, advocate or representative feel that at any time your rights as a SWIBH patient have been violated, please contact our SWIBH Grievance Officer at resolution@swneuropsych.com
Patient Rights:
Safe, high quality medical care without discrimination as to race, color religion, gender, national origin, disability, or sexual
orientation.
SWIBH adheres strictly to privacy laws as outlined by HIPAA. Please review HIPAA form in intake documents for full description of your right to privacy. In the case that your provider has concern for your safety or the safety of others, they may share information without your explicit consent in order to coordinate emergency intervention.
Receive considerate, compassionate care that respects personal dignity, values and beliefs in a clean and safe environment. Participate and make decisions about your care, including the right to refuse care, to the extent permitted by law. Your behavioral health care provider will explain the consequences of refusing recommended treatment.
If you require alternative care options, SWIBH will do it’s best to make appropriate referrals within the community. However, SWIBH cannot guarantee availability of such services and is not responsible for establishing care elsewhere on your behalf.
Rights of Adults and their Caregivers with Power of Attorney/Guardianship: Please be aware that any adult representing the behavioral health interests of another adult 18 years and older, will be required to provide legal documentation demonstrating their capacity to provide consent for services and/or receive confidential information (as protected by federal HIPAA rights), on behalf of the adult receiving treatment services at SWIBH. Rights of Minors: Please note that we are subject to the New Mexico laws, regulations, and statutes for minors. Current New Mexico Statutes [32A-6A-15 1978] Consent for services; children fourteen years of age and older.
A child fourteen years of age or older is presumed to have capacity to consent to treatment without consent of the child's legal custodian, including consent for individual psychotherapy, group psychotherapy, guidance counseling, case management, behavioral therapy, family therapy, counseling, substance abuse treatment or other forms of verbal treatment that do not include aversive interventions. Nothing in this section shall be interpreted to provide a child fourteen years of age or older with independent consent rights for the purposes of the provision of special education and related services as set forth in federal law. Psychotropic medications may be administered to a child fourteen years of age or older with the informed consent of the child. When psychotropic medications are administered to a child fourteen years of age or older, the child's legal custodian shall be
notified by the clinician.
Patient Responsibilities:
To provide, to the best of your knowledge, accurate and complete information: About present complaints, past illnesses, hospitalizations, medications and other matters relating to your health; Regarding insurance status and income documentation, as necessary and requested, in accordance with SWIBH requirements; and Signature FAILURE TO COMPLY WITH THESE RIGHTS AND RESPONSIBILITIES MAY RESULT IN DISMISSAL FROM SWIBH, AT THE DISCRETION OF SWIBH.
I understand my patient rights and responsibilities as outlined above. I understand that failure to comply with these rights and responsibilities may result in dismissal from care at SWIBH, at the discretion of SWIBH.
